CONSUMER TERMS OF SALE for UCABLES.COM (ES)

PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE

1. Contract
1.1 These terms of sale apply to all goods supplied by Ucables (ES), whose office is at Lagartijo, 22 Local 3. Cordoba 14005, registered in Spain
1.2 No contract exists between you and uCables for the sale of any goods until uCables has received and accepted your order and received payment in full (in cleared funds). Once uCables does so, there is a binding legal contract between you and uCables.
1.3Acknowledgement of your order will be sent to you via e-mail when you place your order, but acceptance of your offer to buy the goods will not take place until after your payment is taken and you receive your acceptance e-mail. It is at this point that a binding legal contract is created and any contract is subject to these Terms and Conditions.
1.4 The contract is subject to your right of cancellation (see below).
1.5 Ucables may change these terms of sale without notice to you in relation to future sales.

2. Description and price of the goods
2.1 The description and price of the goods you order will be as shown on uCables website at the time you place your order.
2.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, ucables will inform you as soon as possible and/or re-credit your account for any sum that has been paid by you .
2.3 Every effort is made to ensure that prices shown on ucables website are accurate at the time you place your order. If an error is found, uCables will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order. ucables will allow a 7 day period for you to contact them directly to confirm the order .  If you cancel the order, or if the order is cancelled automatically due to the expiry of the 7 day period, ucables will re-credit you for any sum that has been paid by you into your account so that you can use it in future purchases.
2.4 All prices quoted on the website do not include shipping cost, this cost is calculated once you place the order directly from ucables website.

3. Payment
3.1 Payment for the goods and delivery charges can be made by any method shown on uCables website at the time you place your order. Payment needs to be made before order is delivered, only in the case of Cash On Delivery are goods shipped before payment, for any other option payment must be received first. .
3.2 Orders are not processed until money is shown in bank accounts, paypal payments or Western union confirmation is correct.


4. Delivery
4.1 The goods you order will be delivered to the address you give when you place your order.
4.2 Orders placed before 12.00 pm for international orders or 5:00pm for Spanish and Portugal order will be processed to leave that day. Any order place after those times quoted will be schedule for delivery next working day ( Weekdays/working days = Monday to Friday , weekends and public holidays not included)
4.3 If there is a problem with the delivery of your package or if the courier company can not deliver the goods. uCables will request item to be returned and send it via other means. You will be adviced of such change via email.
4.4 If you deliberately fail to accept the goods delivered, uCables will:
    4.4.1 not credit the account , charge you for the shipping cost incured to ucables.
    4.4.2 Deduct 20% of the total price of the item to cover for storage cost.
4.5
If you fail to accept delivery because you have cancelled your order beforehand, but after the order has been processed and sent. You are to accept the item and return the item back to uCables at your own expense. Once item is received, your account will be re-credited and such credit can be used for any future purchase. 20% will be deducted from the total to cover storage cost.
4.6 Every effort will be made to deliver the goods as soon as possible after your order has been processed.
4.7 All packages need to be signed when received. If you notice the package is torn, or you think it has broken parts inside, you can accept the package and file a claim with the courier service directly. Make sure that you indicated next to the signature that the package is "unchecked" . We need for you to accept the package so that we can file a claim with the courier company. We will send a replacement as soon as the broken item is sent back.


5. Your right of cancellation
5.1 You have the right to cancel the order at any time up to the end of 7 working days after you receive the goods .
5.2 To exercise your right of cancellation, you must give written notice to uCables by fax or email giving details of the goods ordered and their delivery. You can also call ucables to indicate that you wish to cancel the order.
5.3 For faulty items: you need to email ucables inmediately if the item you have received is faulty (within 7 days) or if an item you have used has become faulty at no fault of yours ( within 6 months after purchase).Faulty item is to be sent by the customer to us, we will test the item in our warehouse and if the item has become faulty we will send it to our provider for a thorough check. This may take from 2 weeks to 1 month. Once repaired item is sent back to ucables, they will ship it inmediately back to you
5.4 Once you have notified you wish to cancel the order (before the order is processed) ucables will not send the order. If notification is received after order has been processed, you are to return the goods back to ucables and they will credit your account for future purchases.
5.5 uCables does NOT accept returns for : softwares, repair guides sent via .pdf format , access to support area,etc.

6. Warranty
6.1 All goods supplied by ucablesr are warranted free from defects for 6-12 months from the date of supply (unless otherwise stated). 
6.2 This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by ucables, failure to follow the instructions, or any alteration or repair carried out without the approval of ucables tech support.
6.3 If the items received are damaged on delivery, you should notify ucables in writing via e-mail or fax within 7 days.
6.4 If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify ucables in writing via the e-mail address or fax , as soon as possible, within 7 days of the date you noticed the fault.

7. Customs rights : Government agency charged with enforcing the rules passed to protect the country's import and export revenues.Packages sent within the European Union do not need to pay such charges.
Customs rights may apply to goods which are sold from the European Union to any country outside the European union. Customer is responsible for taking care of paying these customs fees, and its paperwork. . Ucables does not pay customs fee for items sent to various countries, nor do they have the list of possible fees whicg may be charged. If additional paperwork or proof of sale is requested by customs official, ucables will provide such information.


8. Data Protection
Ucables does not share you personal details with any other company, other than the courier company. Details shared with our courier companies are the same details indicated by you in the shipping address section of your order form.In cases where there is a fraudulent charged made to your credit card, we may need (by law) to share information with the institution dealing with the matter . This information may be, IP address, billing addres, shipping address, full name, email.
